Terms of Service for MyAffirm.ai Inc

MyAffirm™ Mobile Application and Services

These Terms of Service (“Terms”) form a legally binding agreement between you (“User,” “you”) and MyAffirm.ai Inc, a corporation organized under the laws of British Columbia, Canada (“MyAffirm,” “Company,” “we,” “us,” or “our”).

By accessing or using the MyAffirm mobile application, website, or related services (“Services”), you agree to these Terms.

If you do not agree, do not use the Services.

1. ELIGIBILITY

You must be at least 19 years old or the age of majority in your jurisdiction.

The Services are not directed to children under 13 (or 16 where applicable by law).

2. DESCRIPTION OF SERVICES

The Services provide digital personal development and wellness content, including:

  • Pre-written affirmations

  • User-created affirmations

  • Automated text-to-audio conversion

  • Audiobooks and e-books

  • Guided breathing sessions

  • Visualization exercises

  • Music and soundscapes

  • Optional sharing features

The Services are for educational, reflective, motivational, and informational purposes only.

3. EDUCATIONAL & PHILOSOPHICAL CONTENT NOTICE

Certain content may explore theoretical, philosophical, or unconventional perspectives.

All such content:

  • Is expressive and theoretical in nature

  • Does not assert factual accusations

  • Does not claim individuals are targeted or manipulated

  • Does not replace professional advice

Nothing in the Services constitutes medical, psychological, psychiatric, legal, or financial advice.

4. NO MEDICAL OR MENTAL HEALTH ADVICE

The Services:

  • Do not diagnose or treat medical or psychiatric conditions

  • Are not therapy

  • Are not crisis services

You acknowledge:

  • You are solely responsible for your health decisions

  • You will consult licensed professionals when needed

  • The Services do not replace treatment

If you are in crisis or experiencing self-harm thoughts, contact emergency services immediately.

5. NO RELIANCE

You acknowledge:

  • No therapist-client or doctor-patient relationship is created

  • You are not relying on MyAffirm as a licensed professional

  • You assume responsibility for your interpretation and decisions

6. ASSUMPTION OF RISK

You voluntarily assume all risks associated with use of the Services, including emotional, psychological, or behavioral responses.

You expressly waive any claim for emotional distress, mental anguish, or psychological injury arising from your use of the Services to the maximum extent permitted by law.

7. USER-GENERATED CONTENT

Users may create affirmations and convert them into audio format.

You are solely responsible for your content.

MyAffirm:

  • Does not review content prior to creation

  • Does not endorse user content

  • Does not verify accuracy

  • Is not responsible for consequences of user content

You represent that your content:

  • Is lawful

  • Does not infringe intellectual property

  • Is not defamatory

  • Does not promote violence

  • Does not encourage self-harm

  • Does not impersonate professionals

  • Does not provide medical advice

  • Does not harass or threaten

MyAffirm reserves the right to remove content at its sole discretion.

MyAffirm has no obligation to monitor user-generated content.

Users retain ownership of their content but grant MyAffirm a worldwide, non-exclusive, royalty-free license to host and process it for operational purposes.

8. AUTOMATED AUDIO GENERATION

Audio affirmations generated from user input are created automatically by software systems.

MyAffirm does not interpret, evaluate, or validate user-submitted text.

9. SOCIAL SHARING

Users assume full responsibility for content shared outside the app.

MyAffirm is not responsible for third-party use, interpretation, or response to shared content.

10. COPYRIGHT & DMCA POLICY (U.S.)

If you believe content infringes your copyright, send notice to:

Include:

  • Identification of copyrighted work

  • Identification of infringing material

  • Contact information

  • Good faith statement

  • Signature

Repeat infringers may have accounts terminated.

11. INTELLECTUAL PROPERTY

All proprietary content created by MyAffirm is protected by intellectual property laws.

Unauthorized reproduction is prohibited.

12. SUBSCRIPTIONS & PAYMENTS

Subscriptions renew automatically unless canceled through your app store account.

Refunds are governed by Apple or Google policies.

Pricing may change without notice.

13. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED “AS IS.”

MYAFFIRM DISCLAIMS ALL WARRANTIES INCLUDING:

  • MERCHANTABILITY

  • FITNESS FOR A PARTICULAR PURPOSE

  • NON-INFRINGEMENT

  • ACCURACY

  • CONTINUOUS AVAILABILITY

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

MyAffirm shall not be liable for:

  • Indirect damages

  • Consequential damages

  • Emotional distress

  • Psychological harm

  • Lost profits

  • Data loss

  • Business interruption

Total liability shall not exceed the greater of:

  • USD $100
    OR

  • Amount paid by you in the previous 12 months.

Punitive, exemplary, and special damages are excluded.

15. ONE-YEAR LIMITATION PERIOD

Any claim must be filed within one (1) year after the cause of action arises, or it is permanently barred.

16. CALIFORNIA CIVIL CODE §1542 WAIVER

To the fullest extent permitted by law, you waive rights under California Civil Code §1542 regarding unknown claims.

17. INDEMNIFICATION

You agree to indemnify MyAffirm against claims arising from:

  • Your content

  • Your use of Services

  • Violation of these Terms

  • Violation of third-party rights

18. DISPUTE RESOLUTION; BINDING ARBITRATION (U.S.)

This section is governed by the Federal Arbitration Act (FAA).

All disputes shall be resolved through individual arbitration administered by the American Arbitration Association (AAA).

Delegation

The arbitrator determines arbitrability.

Informal Resolution

You must provide written notice and allow 30 days for resolution.

Class Action Waiver

No class, collective, or representative actions permitted.

Mass Arbitration

Claims of 25+ similar filings proceed in batches of 10.

Small Claims Exception

Individual small claims court allowed.

Opt-Out

Users may opt out within 30 days of first acceptance.

19. GOVERNING LAW

Except where preempted by the FAA, these Terms are governed by the laws of British Columbia, Canada.

20. FORCE MAJEURE

MyAffirm shall not be liable for delays or failures due to events beyond reasonable control, including cyberattacks, natural disasters, or government actions.

21. INTERNATIONAL USERS

Users are responsible for compliance with local laws in:

  • Canada

  • United States

  • United Kingdom

  • Australia

  • All other Countries

22. DATA & STORAGE DISCLAIMER

Users are responsible for maintaining copies of their content.

MyAffirm is not liable for loss of user-generated data.

23. TERMINATION

MyAffirm may suspend or terminate accounts at its discretion.

24. SEVERABILITY

If any provision is unenforceable, remaining provisions remain in effect.
